How Does Driving in a No-Fault State Like Florida Affect You?

According to the Florida Department of Highway Safety and Motor Vehicles (FLHSMV), more than 1,000 accidents occur daily in the Sunshine State. This statistic shows that no one is exempt from being involved in a crash, regardless of how careful they are. For this reason, Florida law requires all drivers to carry a minimum of:

  • PIP (Personal Injury Protection): $10,000
  • PDL (Property Damage Liability): $10,000

PIP Covers:

  • 80% of medical expenses
  • 60% of lost wages
  • Death benefits

PDL Covers:

  • Property damage caused in the accident—your damaged car.

If you only have the state’s minimum required coverage, it may not be enough to cover all damages in an accident. So, who pays the difference? In this case, the at-fault driver could be sued for injuries or damages.

What to Do If You Have an Accident in Florida:

  1. Stop your vehicle without blocking the road.
  2. Report the accident to the police immediately.
  3. If anyone is injured, seek medical help.
  4. Exchange personal and insurance information with the involved parties.
  5. Take photos and gather witness details.
  6. File a police report.
  7. Call your insurance company to report the accident.

Important: To receive PIP benefits, you must seek medical attention within 14 days of the accident and keep all medical bills to submit to your insurer.
