I Name My Child as Beneficiary

A parent’s greatest concern is ensuring their child’s well-being. This is why life insurance, which guarantees the family’s financial stability, is so appealing. But what happens if a minor is named as the beneficiary of a life insurance policy and the parent passes away before the child reaches adulthood? As my grandmother used to say, “the devil is in the details.”

Florida laws do not allow a minor to directly receive the death benefit from a life insurance policy. In most cases, the Florida probate court appoints a guardian to manage the funds and use them for the benefit of the minor, which could raise some concerns. Additionally, the legal process to appoint the guardian is often costly and time-consuming, meaning that the child could be without the financial support from the death benefit during this period.

Depending on the circumstances, it might be a good idea to designate your spouse as the beneficiary to ensure they have the necessary funds to care for and educate the minor child.

There are more sophisticated options, such as naming a custodian to manage the funds through a UTMA (Uniform Transfers to Minors Act) account until the child reaches adulthood. At that point, the funds would be transferred to the beneficiary. However, keep in mind that funds in a UTMA account are in the child’s name, which could negatively impact their eligibility for financial aid or scholarships.

Conclusion: Consider all these aspects before naming your minor child as the beneficiary of your life insurance.
